Terms and Conditions
These terms are a working draft prepared as a starting point. Have them checked against Belgian and EU consumer law before you rely on them.
1. Who we are
[REVIEW — legally required] EU law requires an online trader to identify itself. Fill in all of the following and delete this note:
- Registered business name
- Trading name (Saha Essential)
- Full geographic address — a PO box is not sufficient
- Belgian company number (KBO/BCE)
- VAT number, if registered
- Contact email and phone
Until these are filled in, this page does not meet the disclosure requirements for selling to EU consumers.
2. These terms
By placing an order through this website you agree to these terms. We may update them; the version in force is the one published when you order.
3. Orders and contract formation
Your order is an offer to buy. A contract is formed when we send you a dispatch confirmation, not when you receive the order confirmation. If we cannot fulfil an order — because an item is out of stock or a price was listed in error — we will tell you and refund you in full.
4. Prices and payment
Prices for EU customers are shown in euro and include VAT where applicable. Delivery costs are shown separately at checkout before you pay. Payment is taken at checkout through Shopify's payment providers; we do not store your card details.
5. Right of withdrawal and returns
Your statutory 14-day right of withdrawal, our voluntary 30-day window, and the model withdrawal form are set out in full in our Return Policy, which forms part of these terms.
6. Legal guarantee of conformity
Goods must be as described and fit for purpose. Under EU law you have a two-year legal guarantee against defects present at delivery. This is free of charge and exists alongside the withdrawal right.
7. Product information
Our pillows are comfort and support products. They are not medical devices, and nothing on this website should be read as a claim to diagnose, treat, cure or prevent any condition. Product photography is indicative; colours may vary between screens.
8. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, our liability for any claim arising from an order is limited to the value of that order.
9. Governing law and disputes
These terms are governed by Belgian law. As a consumer you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings in your own country's courts.
The European Commission operates an Online Dispute Resolution platform for consumer disputes, available at ec.europa.eu/consumers/odr. [REVIEW] Confirm this platform is still operating before launch — the Commission has been winding it down.
